In 2023 a struggle on an extension of section 702 of the Foreign Intelligence Surveillance Act (FISA) issue started in the U.S. Congress. This section regulates an intelligence community (IC) surveillance on non-U.S. persons when they are abroad. But IC members exceed an authority given them by FISA and broadly collected electronic communications of U.S. persons. This was the violating of the fourth amendment to the U.S. Constitution which prohibited unreasonable searches. It became the reason publicly sounded by members of the House of Representatives from both main parties for insisting on a significant reforming sec. 702. A case of IC illegal surveillance isn’t something new for the USA by itself. For example, even FISA appeared as a result of the Watergate scandal. But there was an unusual composition of sides which took part in this current case. The White House controlled by the Democrats and allied them IC was staying on 702’s renewal without significant amendments. But an unreconciled opposition included the Republicans and again the Democrats. Both sides seemed to be not ready to a compromise. But both sides underlined 702’s big importance as an instrument of National Security defending. So it was obvious that the compromise would be reached. And finally it was reached in a very unexpected way and D. Trump took part in it. This research is an attempt to find true reasons of this struggle between U.S. groups of power.
